Vieques Wellness and Yoga (Vieques Natural Wellness & Events LLC) Retreat Agreement and Reservation Form

1. Please read carefully, the WELLNESS AND YOGA RETREAT AGREEMENT (the “Agreement”) within this reservation form.

2. By completing and submitting this form, you agree to be bound by the Agreement between Vieques Natural Wellness & Events LLC (the “Company”) and you (the “Participant”).

3. To submit the form, enter the Participant Information, agree to the terms, enter the answer to the mathematical equation in the box (for security) and then click the BOOK NOW button.

4. When the form is submitted, the Participant will automatically be redirected to the retreat deposit page to complete payment and confirm the reservation.

WELLNESS AND YOGA RETREAT AGREEMENT

Please read carefully, the WELLNESS AND YOGA RETREAT AGREEMENT (the “Agreement”) within this reservation form. By completing and submitting this form, you agree to be bound by the Agreement between Vieques Natural Wellness & Events LLC (the “Company”) and you (the “Participant”).

This WELLNESS AND YOGA RETREAT AGREEMENT is made and entered into effective on the date the Participant Information and booking deposit payment are submitted and received by and among:

Full Name of (“Participant”) and Vieques Natural Wellness & Events LLC, (“Company”).

Section 1. Registration and Space Reservation

The Participant must register by completing the Participant Information form and reserve a space by submitting the form together with the required non-refundable retreat deposit payment. 

Section 2. Payment

The retreat deposit payment, equal to one third of the total retreat program price per person, must be made at time of booking to reserve the Participant’s space. The deposit is non-refundable. Payment in full is available at booking by adding “RETREAT Payment in Full” to the order. If the retreat program is not paid in full at booking, the next payment of one third of the total, is due 60 days prior to the retreat start date. The remaining balance is due 30 days prior to the retreat start date. Payments must be made by credit card or bank transfer via secure credit card processor, Stripe. Credit card payments will incur a 3% processing fee. Bank transfers do not incur additional fees. An invoice for the amount due will be emailed 7 days prior to each payment due date. If the retreat program is paid in full at booking, no additional invoice will be sent. If the balance due is not received on or before each payment due date, it is assumed that the Participant will not attend the retreat and the spot may be forfeited or offered to the waitlist. Cancellation charges in accordance with Section 3 will apply. 

Section 3. Participant Cancellations

If the Participant wishes to cancel their registration and retreat reservation, Vieques Natural Wellness & Events LLC must be notified in writing by email at [email protected] to submit a notice of cancellation. When the notice is received, cancellation will take effect subject to the following:

• If the Participant cancels 60 days or more from the retreat start date, any payments made will be refunded, minus the deposit and all applicable credit card processing fees. Both the retreat deposit and applicable credit card fees are non-refundable.
• If the Participant cancels 59 days or less from the retreat start date, any payments made including the deposit will be forfeited. The participant will not receive a refund or credit for any reason. One hundred percent of the retreat price will be forfeited.
• If the Participant does not attend the retreat for any reason, no refund or credit will be issued and one hundred percent of the retreat price will be forfeited.
• If the Participant leaves the retreat early for any reason, no refund or credit will be issued and one hundred percent of the retreat price will be forfeited.

Vieques Natural Wellness & Events LLC strongly recommends the Participant purchase personal travel insurance to cover unforeseen changes to travel plans. 

Section 4. Participant Name Transfer Policy

The Participant’s retreat reservation may be transferred, one time only, to a new participant’s name, pending the new participants completion of the WELLNESS AND YOGA RETREAT AGREEMENT and written approval by Vieques Natural Wellness & Events LLC. Deadline to make a Participant name transfer is 30 days prior to the retreat start date. The original retreat booking Participant will be charged a transfer fee of $250 for this service. The Participants balance must be paid in full in order to make a name transfer request. To make a name transfer request, submit the request in writing to [email protected] prior to the 30 day deadline. Vieques Natural Wellness & Events LLC reserves the right to approve or deny a transfer request for any reason.

Section 5.  Health Requirements

The Participant must be in good physical and mental health to participate in the retreat. The Participant is advised to consult with a physician to ensure their adequate health to safely participate in the retreat. Our retreats may take place in remote areas, islands or countries where there is little or no access to typical medical services or hospital facilities for serious medical issues. All medical and evacuation expenses are the sole responsibility of the Participant. Vieques Natural Wellness & Events LLC strongly recommends the Participant purchase personal travel insurance to cover unforeseen medical expenses. Additionally, Vieques Natural Wellness & Events LLC and the retreat leader reserve the right in their absolute discretion to refuse the Participant the right to participate in a retreat, if determined the Participant does not meet adequate health condition physically or mentally to participate. No refund or credit will be given if the Participant chooses or is required to leave the retreat early. Any special requests should be made at the time of booking.

Section 6. Cancellation Due to Retreat Attendance

Vieques Natural Wellness & Events LLC reserves the right to cancel any retreat prior to departure in the event that the required minimum attendance has not been met in which case the Participant will be given a full refund of any deposit or retreat payments made to Vieques Natural Wellness & Events LLC minus applicable credit card processing fees. Credit card fees are not refundable. The Participant will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage either direct or consequential or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa and passport fees and expenses, flights, flight cancellation and reservation fees, and vaccination costs). For this reason, Vieques Natural Wellness & Events LLC strongly recommends the participant purchase travel insurance to cover unforeseen changes to travel plans.

Section 7. Cancellation, Modification, Postponement or Delay 

Vieques Natural Wellness & Events LLC reserves the right to cancel, modify, postpone or delay any aspect of the retreat, including but not limited to setting and dates, at its sole discretion. If circumstances beyond the Company’s control arise that prevent the safe operation of the program, cancellation, modification, postponement or delay may occur. Circumstances include, but are not limited to, hazardous or dangerous conditions, adverse weather, political or military situations, terrorist activity, natural disasters, government-issued travel warnings or advisories, or other unforeseen events beyond the Company’s control.

In the unlikely event that cancellation is necessary, Vieques Natural Wellness & Events LLC will refund all payments received, excluding the non-refundable deposit and any applicable credit card processing fees. Vieques Natural Wellness & Events LLC is not liable for any additional expenses incurred by the Participant, including but not limited to airfare, accommodation, rebooking fees, travel insurance, or other related costs resulting from the cancellation.

In the event of any cancellation, modification, postponement or delay, the Participant acknowledges to have no right of refund of the retreat price in whole or in part and no right to claim compensation for any injury, loss, damage or other expenses incurred by virtue of the modification, cancellation or postponement. 

Section 8. Insurance

Vieques Natural Wellness & Events LLC strongly recommends the Participant purchase personal travel insurance to cover unforeseen travel and medical expenses. It is the sole responsibility of the Participant to purchase adequate insurance coverage for the full duration of the travel dates in respect to trip cancellation, trip interruption, trip delay, lost baggage or personal effects, baggage delay, accident, illness, injury, hospitalization, medical expenses and emergency medical evacuation. Cancel for any reason (CFAR) and Interruption for any reason (IFAR) can be added to most policies.  

It is imperative to purchase personal travel insurance in the unlikely event the Participant is unable to attend the booked retreat. There will be no refund or credit issued for arriving late, leaving early, flight cancellations or travel delays. No refund of any kind will be issued once a booked retreat has passed the 60 day deadline. If the Participant is covered by a major credit card, be sure to review the domestic and international coverage details and requirements prior to departure.

Section 9. Travel Documents and Vaccinations

It is the Participant’s responsibility to learn about and obtain all required documents for travel to the retreat destination. Vieques Natural Wellness & Events LLC is not responsible for any delays or cancellations due to the Participant’s lack of proper travel documents, including valid passports, visas, health certificates and other documents that may be required by the country where the retreat is located.

Section 10. Photo and Video

Vieques Natural Wellness & Events LLC reserves the right to use photographs and/or videos from the retreat for promotional purposes. By making a reservation with Vieques Natural Wellness & Events LLC, the Participant agrees for their image to be used in such photography. If the Participant prefers their image not be used, please notify Vieques Natural Wellness & Events LLC in writing before the retreat commences and your image will not be used.

Section 11. Alcohol and Drugs

To promote sobriety, safety and wellness during the retreat, all retreat accommodations and activities will be one hundred percent alcohol and drug free. If the Participant chooses to purchase alcohol, during off-site excursions, no alcohol is to be brought back to the accommodations or consumed during any group wellness activity. Violation of Section 11 is subject to the Participants dismissal without credit or refund. Vieques Natural Wellness & Events LLC and the retreat leader reserve the right in their absolute discretion to dismiss the Participant, if determined the Participant is in violation of Section 11.

Section 12. Force Majeure

If Vieques Natural Wellness & Events LLC and or the retreat leader are prevented from performing any obligation under this Agreement by acts of God, strikes, trade disputes, fire, weather, breakdowns, interruption of transport, government or political action, acts of war or terrorism, pandemic, acts or omissions of a third party or for any other cause whatsoever outside Vieques Natural Wellness & Events LLC and the retreat leader’s reasonable control, Vieques Natural Wellness & Events LLC and the retreat leader will be under no liability whatsoever to the Participant and may either cancel or postpone the retreat. See Section 7. 

Section 13. Assumption of Risk

The Participant acknowledges that traveling internationally is inherently more challenging and involves a greater degree of risk than domestic travel. In the locations where our retreats are conducted, the standards of service may differ from those in the United States, often requiring additional flexibility and patience from participants. The Participant further recognizes that the control of the retreat is held by a third party, and any claims regarding deficiencies in that third party’s performance must be directed toward the third party, not towards Vieques Natural Wellness & Events LLC.

The Participant understands and accepts that yoga and other fitness activities involve physical movement, mental focus, and breathing exercises. As with any form of physical activity, there is always a potential risk of injury, including serious or disabling injuries, which cannot be entirely eliminated. The Participant fully acknowledges and assumes responsibility for any risks, conditions, injuries, or damage, whether known or unknown, that may occur or be aggravated as a result of participation in yoga, fitness, meditation, sound bath, or breathwork classes provided by Vieques Natural Wellness & Events LLC. It is recognized that yoga is not a substitute for medical attention, examination, diagnosis, or treatment, and that yoga and fitness activities may not be recommended or safe under certain medical conditions. The Participant accepts responsibility for consulting with a physician prior to engaging in any yoga or fitness class and obtaining the necessary medical approval. Additionally, it is the Participant’s responsibility to inform the yoga or fitness instructor of any injuries or surgeries prior to the start of class.

Section 14. Release and Waiver of Liability

The Participant affirms that the decision to participate in any yoga, breathwork, meditation, fitness or wellness session, self-discovery workshop, or any other activity offered at the wellness and yoga retreat, including but not limited to, sailing, snorkeling, hiking, paddle boarding, swimming, and spa services, is solely the Participant’s responsibility.

The Participant agrees to irrevocably release, waive, hold harmless, defend, and indemnify Vieques Natural Wellness & Events LLC, including its officers, employees, agents, licensees, teachers, independent contractors, retreat leaders and other representatives (collectively referred to as the “Released Parties”), from any and all claims, actions, or losses for personal injury, illness, emotional trauma, property damage, wrongful death, loss of services, loss of profits, as well as consequential, exemplary, indirect, or punitive damages, or any other liability that may arise in connection with participation in the wellness and yoga retreat or any additional activities the Participant may engage in during the retreat, whether or not such activities are sponsored by Vieques Natural Wellness & Events LLC (“Claims”). The Participant waives the right to bring any Claims, now or in the future, against the Released Parties and further agrees not to pursue any Claims against any Released Party.
